Managing asbestos in commercial properties - Are you managing the risk?

Your duty to manage
Regulation 4 of the Control of Asbestos Regulations (CAR 2006 – soon to be updated) places a legal duty to manage the risk from asbestos. As an employer, how do you meet the requirements?
- Find out whether your premises contains asbestos; and if so,
- Where it is and what condition it is in;
- Record the information;
- Assess the risk;
- Make a plan to manage that risk and act on it.
Why is asbestos a problem?
When asbestos is disturbed or damaged, fibres are released and can be breathed in, which is a risk to human health. Activities that may result in asbestos fibre release are:

- Accidental damage
- Wear and tear
- Simply working close to asbestos

Do your employees know what asbestos is?
Anyone liable to be exposed to asbestos needs to have had adequate information instruction and training in line with Regulation 10 of CAR 2006. Asbestos awareness training covers safe working practices, control measures and types of products likely to contain asbestos.
Communication of information
The result of surveys and Asbestos Management Plans need to be communicated to various parties to help prevent any uncontrolled disturbance of asbestos containing materials. Employees and contractors alike need to be made aware of the presence of asbestos prior to any work being undertaken.
NOTE: Just having an asbestos survey in place does not demonstrate that you are managing the risk properly!
